FCC Strikes Down Deemed Income Tax on Assets and Property

The Federal Constitutional Court has set aside a provision of the Income Tax Ordinance that empowered the state to levy tax on deemed income derived from immovable assets and property, in a ruling with sweeping implications for Pakistan's fiscal architecture. The court found the contested section legally untenable, removing a key instrument the Federal Board of Revenue had deployed to broaden the tax base beyond declared income streams.

The deemed income tax mechanism had been introduced as part of measures to bring non-productive assets into the tax net, compelling property holders to either rent out assets or pay tax as though they had. Its annulment significantly narrows the government's ability to extract revenue from wealthy individuals holding large real estate portfolios without active income disclosure.

The decision arrives at a particularly sensitive juncture, as Pakistan navigates its ongoing engagement with the International Monetary Fund under a programme that has placed heavy emphasis on revenue mobilisation and documented widening of the tax base. Any statutory erosion of tax instruments is likely to draw scrutiny from programme monitors in Islamabad and Washington.

Legal experts had long contested the constitutional validity of taxing notional or imputed income, arguing it amounted to taxation without an actual income event. The court's ruling vindicates that position but leaves the government with limited time to fashion an alternative mechanism before the next budget cycle.
